PRIVACY POLICY PURSUANT TO ARTICLE 13 OF EU REGULATION 2016/679 – USERS

 

 

1.Definitions

 

  1. Clients: subjects who buy the Products and make use of the Services of the Company, through the Website, upon completion of the necessary registration form, or directly at the Company’s shop.

  2. General Conditions: the general conditions of the Services provided by Mobil Service and published on the Website.

  3. Cookies: cookies are text files (letters and/or numbers) that contain packages of information that are stored on the User’s computer or mobile device whenever they visit a website through a browser. At each subsequent visit the browser sends cookies to the website they originated from or to another website. Cookies can be stored only for a temporary period for use by a particular website (i.e. session cookies), or for a longer period of time and independent of the session (i.e. persistent cookies).

  4. Personal Data: any information relating to an individual, identified or identifiable, directly and indirectly, by reference to their name, identification number, location data, online identifier or elements characteristic of their physical, physiological, genetic, psychic, economic, cultural or social identity.

  5. Privacy Policy: this document, consisting of the policy regarding the processing of Personal Data and our Policy relating to Cookies.

  6. Products: furniture or furnishings sold by Mobil Service.

  7. Profiling: Personal Data Processing through the evaluation of personal aspects of Users with the use of partially or solely automated procedures.

  8. Regulation: EU Regulation 2016/679 of April 27th, 2016.

  9. Services: the User’s purchase of Products through the Website, the delivery of Products at the address given by the User, management and verification of payments, fulfilment of fiscal and accounting obligations related to the purchase, management of purchase orders of the Products and any other ancillary service closely connected.

  10. Website: this website.

  11. Processing: any operation or set of operations concerning Personal Data, such as, by way of example, the collection, organization, structuring, preservation, modification, extraction, consultation, use, communication, interconnection, limitation, cancellation and destruction.

  12. Users: the users of the Website

 

2. Data Controller

 

The Data Controller is Mobil Service S.r.l, with registered office in Trieste, Via G. e D. Economo, 5/A, Italian Fiscal Code, VAT 00922990320 and Trieste Registrar of Companies’ No  REA TS 111163 (“Mobil Service”).

Any request of the User concerning the Processing of Personal Data performed by Mobil Service regarding their Personal Data (including the exercise of the rights referred to in paragraph 9 below), shall be addressed to Mobil Service by registered letter at the legal office, or by e-mail to the following address privacy@icondesignsolution.it.

 

3. Purposes and legal basis of Processing

 

Mobil Service collects and uses Users’ Personal Data for the following purposes:

Navigation on the Website: consent.

a) Enabling navigation on the Website, primarily through the Cookies.

The collection of Personal Data for the purpose referred to in letter a) is regulated in the Cookies Policy, available in sections 10 and 11 of this Privacy Policy, whose reading Mobil Service strongly recommends.

Registration procedure on the Website: consent

b) Enabling the User’s Registration on the Website and the creation of a personal account.

The collection of Personal Data for the purpose referred to in letter b) is necessary for the Users to complete the registration procedure on the Website and, consequently, to use the Services; any refusal prevents the User from using said Services (including the purchase of Products). This Processing is based on the free, specific, informed, and unequivocal consent of the User, expressed through a declaration or positive action (e.g. flag) on the Website. The withdrawal of consent can be exercised at any time, following the instructions set forth in section 9 letter a) of this Privacy Policy.

Client’s purchase of the Products and provision of Services: General Conditions

c) Allowing the Users to purchase Products and use the Services provided by Mobil Service.

The collection of Personal Data for the purpose referred to in letter c) is necessary for the purchase of the Products and the User’s use of the Services; any refusal prevents the User from purchasing Products and using the Services. This Processing is based on the General Conditions signed by the User during the registration process on the Website or during the physical access to Mobil Service’s shop.

Sending of commercial and promotional communication, through Profiling, by Mobil Service: consent.

d) Subject to prior optional further consent, sending informative and promotional material (e.g. newsletter), informing of, and inviting to, promotional initiatives consistent with the Users’ interests regarding the Products and the Services.

The collection of Personal Data for the purpose referred to in letter d) is optional and any refusal prevents the User from receiving newsletter from Mobil Service. This Processing is based on the free, specific, informed, and unequivocal consent of the User, expressed through a declaration or positive action (e.g. flag) on the Website. The withdrawal of consent can be exercised at any time, following the instructions set forth in section 9 letter a) of this Privacy Policy.

Managing of the contact requests: consent.

e) Managing the contact requests received on the Website through the completion of the contact forms by the Users.

The collection of Personal Data for the purposes referred to in letter e) is necessary for the management of contact requests sent by the User. This Processing is based on the free, specific, informed, and unequivocal consent of the User, expressed through a declaration or positive action (e.g. flag) on the Website. The withdrawal of consent can be exercised at any time, following the instructions set forth in section 9 letter a) of this Privacy Policy.

 

4. Personal Data collection procedures

 

Mobil Service collects Personal Data in the following ways:

Personal Data voluntarily communicated by the Users.

a) Personal Data voluntarily communicated by the Users: these are Personal Data entered into the Website by the Users, included, but not limited to, those which are necessary for the registration on the Website, the purchase of Products, and the use of the Services, or those which are provided within access to Mobil Service’s shop;

 

Personal Data collected automatically by the Website (through Cookies).

b) Personal Data automatically collected by the Website: these are Personal Data collected by the Website through, but not limited to, Cookies (for further information, Mobil Service recommends reading the Cookies Policy available in sections 10 and 11 of this Privacy Policy);
 

5. Potential categories of recipients of Personal Data

 

Employees, collaborators, IT service providers, third parties necessary for providing the Services, third party consultants, technical and commercial third parties.

Personal Data are processed by Mobil Service and/or third parties, selected for reliability and competence, and to which such Personal Data may be disclosed, if necessary or appropriate, provided that they are located within the European Union. In particular, Mobil Service informs Users that Personal Data may be processed by, and/or communicated to:


a) employees and/or collaborators of Mobil Service;
b) third parties suppliers of services necessary to guarantee the functioning of the Website (by way of example: a company that deals with hosting services);
c) third parties suppliers of services necessary to guarantee the commerce of the Products and the provision of Services (by way of example: manufacturers, couriers, payment operators);
d) third parties that provide consulting and assistance services (e.g. tax advisor, labour consultants)
e) third parties that provide analysis services of the Website navigation data;

 

6. Retention period of Personal Data (or criteria for its determination)

 

Personal Data are kept by Mobil Service for the terms strictly necessary to achieve the purposes for which they were collected, as indicated in section 3 above. In particular, except for the exercise of the right of withdrawal of the consent referred to in the following section 9 letter a), Mobile Service retains Personal Data for the following periods:

Cookies: see Cookies Policy

a) Cookies: for the purpose referred to in section 3 letter a), the Company advises and strongly suggests to read the Cookies Policy, available in the following sections 10 and 11 of this Privacy Policy;

Personal Data for the use of the Services: duration of the General Conditions and the following 26 months.

b) Personal Data for the use of the Services: for the purpose referred to in section 3 letters b) and c), for the length set forth in the General Conditions and for an additional period of 26 months, without prejudice to section 6 letter e);

Personal Data for promotional purposes: 12 months from the last interaction of the User with the Company.

c) Personal Data for promotional purposes: for the purpose referred to in section 3 letter d), for a period of 12 months from the last interaction of the User with Mobil Service, suitable to show an interest in receiving communications regarding the Company and/or the Products, such as gathering consent, opening newsletter, purchasing Products, using the Services, or participating in initiatives promoted by Mobil Service;

Personal Data of the “contacts” form: 3 months from the receipt of the request. 

d) Personal Data for managing the contact request: for the purpose referred to in point 3 letter e), for a period of 3 months from the receipt of the contact request sent by the User by filling in the designated form on the Website. By way of exception from this deadline, in case of a complaint or a claim being sent via the "contact" form, the User's Personal Data will be kept for the period referred to in letter e) below;

e) in any case, Mobile Service is authorized to keep, in whole or in part, Personal Data for a maximum period of 10 years from their collection, limited to the information necessary to comply with legal obligations and allow Mobil Service itself to investigate, exercise, and defend, where applicable, its own rights.

Once the above terms have expired, Mobil Service will automatically delete the Personal Data collected, or irreversibly transform them into anonymous data.

 

7. Potential transfer of Personal Data to non-EU countries

 

Not applicable (no transfer of Personal Data are made to non-EU countries)

 

8. Profiling

 

Automated processing of Users’ Personal Data with the purpose to send notifications, and commercial and promotional initiatives (e.g. newsletter).

Profiling performed by Mobil Service has the following characteristics:
a) context: Users are physical and legal people, who, voluntarily, have manifested their interest in the Services through the purchase of a Product;
b) subject: Profiling is limited to the Users’ Personal Data gathered on the Website;
c) purpose: improve the visibility of the Company, the Website and/or the Products by sending commercial and promotional notifications to the Users potentially interested in the Products and Services offered by Mobil Service;
d) periodicity: the commercial and promotional notifications that Mobil Service intends to carry out would be, at most, monthly;
e) effects for the Users: receipt of commercial and promotional notifications regarding the Products and Services. In no way, the Profiling of Mobil Service: i) constitutes a partially or solely automated decision-making process from which derive legal or similarly significant effects for the Users; ii) jeopardizes the behaviour of the Users; iii) has a long and permanent impact on Users, considering that the Personal Data collected by Mobil Service can be independently updated at any time by the Users; iv) determines any kind of discrimination of Users. 

 

9. Users’ Rights

 

Withdrawal of consent, access  to Personal Data, correction or integration of Personal Data, deletion of Personal Data, limitation of Processing, opposition to Processing, portability of Personal Data, data breach, complaint to competent authorities.

Pursuant to and for the purposes of the Regulation, for the period of time specified in section 6 of this Privacy Policy, each User has the right to:


a) with reference to the Processing of Personal Data referred to in section 3 letters b), d) and e), withdraw the consent at any time, without prejudice to the lawfulness of the Processing, by sending an email to Mobil Service or by opting out from the commercial communications of Mobil Service (see Article 7 of the Regulation);
b) ask Mobil Service to access to Personal Data and information regarding the Processing, and to any copy in electronic format, unless otherwise specified by the User (see Article 15 of the Regulation);
c) request the correction and/or integration of Personal Data, without undue delay (see Article 16 of the Regulation);
d) for specific reasons (for example, unlawful processing, withdrawal of consent, non-existence of the purpose of the Processing), request cancellation of Personal Data, without unjustified delay (see Article 17 of the Regulation);
e) with reference to specific cases (for example, inaccuracy of Personal Data, unlawful Processing, exercise of a right in court), request the limitation of Processing (see Article 18 of the Regulation);
f) in case of automated Processing, receive Personal Data in a readable format, in order to allow their communication to a third party, or, where technically feasible, to request the transmission of Personal Data by Mobil Service directly to such third party (so-called portability of Personal Data - see Article 20 of the Regulation);
g) be informed by Mobil Service without undue delay of any violations or unauthorized access by third parties to their systems containing Personal Data (so-called data breach - see Article 34 of the Regulation);
h) propose a complaint to the supervisory authority of the EU country in which the User resides, works, or in which they believe the violation of their rights has occurred (see Article 77 of the Regulation).

10. Types of Cookies

 

Technical Cookies:

Cookies necessary to browse necessary and functional to the browse on the Website.

a) Purpose: Cookies essential to guarantee the correct functioning of the Website, for they allow the User to browse within the Website and use its basic features. Under no circumstances do these Cookies gather information likely to be used for commercial purposes. Said necessary Cookies are also needed to: (i) memorise the data given by the User during a session within the Browser; (ii) maintain active the User’s preferences and credentials during the navigation within the Website; (iii) display the content in the preferred language at each access, identifying from what nation the User is connected (and remembering such setting for future log ins). a) Purpose: Cookies provided by Google Inc. to monitor, in anonymous and aggregate form, the statistical analysis of Users’ traffic on the Website in order to customise the Website in regard with the Users’ interest emerged from such analysis.
b) Collected Data: Data related to the computer and the User’s visit on the Website. Such Data, under no circumstances, permit Mobil Service to independently trace Users’ Personal Data: (i) the domain from which the User accesses to the internet; (ii) the web address, where available, from which the User accesses to the Website; (iii) the time and date of the access to the Website, for how long it lasted, and which pages have been visited; (iv) the internet protocol address (IP) of the User; (v) the computer’s operating system and the browser used by the User; (vi) the aggregated demographic details of the Users that access to the Website.
c) Duration: session Cookies.

a) Purpose: Cookies operated by third parties (e.g. Pinterest, Facebook, etc.), through plugin, to allow the Users to easily share to their social network profiles the contents of the Website.
b) Collected Data: the collection, procedure, and purpose of use of the Data and the Users’ information gathered through such Cookies are regulated by the third parties in their respective cookies policies.

a) Purpose: Mobil Service uses profiling Cookies with the objective of improving the commercial experience of the Users by offering contents shaped on personal preferences and habits, as well as by sending advertisements regarding solely the Products that result to be the most related to the User’s interests.
b) Collected Data: Data related to the computer and the User’s visit on the Website, used to create a “navigation profile” of the User, based on the latter’s internet searches and most consulted sections of the Website.
c) Duration: both session and permanent Cookies.

a) Purpose: third parties’ advertising Cookies are Cookies provided for by websites to which Mobil Service refers through links or banners within its Website, as they are third parties’ websites that have resulted to be related to the User’s interests. Such activity is carried out with the objective of sending information and commercial offers based on interests linked to the User’s online activity. Such Cookies do not personally identify the Users.
b) Collected Data: data and information on online orientations and/or preferences of the Users such as, by way of example, internet searches, frequency of page loading, or the activity on third parties’ websites.
c) Duration: both session and permanent Cookies.

11. Acceptance or waver of Cookies
